Bylaw 6: Administration

6.1. Chief Executive Officer and Registrar

6.1.1. Council will appoint a Registered Nurse as Chief Executive Officer and Registrar under Section 8 of the Act

6.1.2. The Chief Executive Officer and Registrar is responsible for the operation of and overseeing the administration of the College as directed by Council in accordance with these Bylaws.

6.1.3. The Chief Executive Officer and Registrar will perform all duties required of and exercise the powers provided to the Registrar in the Act, the Regulations and these Bylaws.

6.1.4. The Chief Executive Officer and Registrar reports to Council.

6.1.5. The Chief Executive Officer and Registrar may delegate in writing any of their duties and responsibilities to another person with or without conditions.

6.1.6. The Registrar appointed under Section 8 of the Act may:

6.1.6.1. consider applications for registration and applications for a practice permit,

6.1.6.2. undertake any other power or duty given to the Chief Executive Officer and Registrar under the Act, the Regulations or these Bylaws, and

6.1.6.3. subject to Sections 19 and 20 of the Act, execute any powers and duties delegated by Council.

6.1.7. If the practice permit or registration, or both, of a registrant has been cancelled, the registration and practice permit are not to be reinstated except by order of the Chief Executive Officer and Registrar, who may refer the matter to the Registration Committee.

6.1.8. The Chief Executive Officer and Registrar may in their sole discretion decide to refer any application for registration or practice permit to the Registration Committee or the Competence Committee for their determination.

6.1.9. The Chief Executive Officer and Registrar may delegate in writing all or any of their duties and responsibilities to another staff member, with or without conditions.

6.1.10.The Chief Executive Officer and Registrar or designate is authorized to prescribe such forms, certificates, permits or other documents that may be required for the purposes of the Act, the Regulations or these Bylaws.

6.2. Acting Chief Executive Officer and Registrar

6.2.1. If the office of the Chief Executive Officer and Registrar becomes vacant or the Chief Executive Officer and Registrar otherwise becomes incapable of acting for any reason, Council may appoint an Acting Chief Executive Officer and Registrar, who will have all the powers and duties of the Registrar under the Act, the Regulations and these bylaws.

6.2.2. The Acting Chief Executive Officer and Registrar holds office until:

6.2.2.1. The Chief Executive Officer and Registrar again becomes capable of acting;

6.2.2.2. Council appoints a new Chief Executive Officer and Registrar; or

6.2.2.3. Council terminates the appointment of the Acting Chief Executive Officer and Registrar.

6.3. Complaints Director

6.3.1. The Complaints Director appointed under Section 14 of the Act may undertake any power or duty given to the Complaints Director under the Act, the Regulations or these Bylaws.

6.3.2. The Complaints Director may delegate some or all of their duties to an individual, with the exception of the Hearings Director.

6.3.3. The Complaints Director may disclose any information regarding a complaint or disciplinary proceeding if:

6.3.3.1. The information is required to be disclosed for the purposes of the Act, the Regulations or these Bylaws;

6.3.3.2. The information is required to be disclosed by law; or

6.3.3.3. The information is disclosed to a law enforcement agency for the purpose of reporting potential criminal conduct or for the purpose of providing information for a law enforcement investigation.

6.4. Hearings Director

6.4.1. The Hearings Director appointed under Section 14 of the Act may undertake any power or duty given to the Hearings Director under the Act, the Regulations or these Bylaws.

6.4.2. The Hearings Director may delegate some or all of their duties to an individual, with the exception of the Complaints Director.

6.4.3. The Hearings Director may disclose any information regarding a complaint or disciplinary proceeding if:

6.4.3.1. The information is required to be disclosed for the purposes of the Act, the Regulations or these Bylaws;

6.4.3.2. The information is required to be disclosed by law; or

6.4.3.3. The information is disclosed to a law enforcement agency for the purpose of reporting potential criminal conduct or for the purpose of providing information for a law enforcement investigation.

6.5. Council Designations

In consultation with the Chief Executive Officer and Registrar, Council will designate a staff member to carry out the duties under Section 65 and Section 86 of the Act.

6.6. Fiscal and Practice Year

The fiscal and practice year of the College will be from October 1 to the following September 30.

6.7. Use of Funds

6.7.1. The College is entitled to make use of all revenues received from fees and other sources of income to carry out the objectives of the College.

6.7.2. Financial policy pertaining to the College will be determined by Council and the College will publish annually a copy of its audited financial statement.

6.8 Seal

6.8.1. The College will have a Seal which will consist of the words "College of Registered Nurses of Alberta".

6.8.2. The Chair and the Chief Executive Officer and Registrar of the College and such other person or persons as may be authorized by Council will each have authority to affix the Seal of the College to any document requiring the Seal to be affixed.

6.9. Parliamentary Authority

Any rules adopted by the College will govern the College in all cases to which they are applicable and in which they are not inconsistent with these bylaws. On those matters not covered by the College rules of order, Robert’s Rules of Order will apply.
